Important Changes in the Employment of People with Disabilities and the Minimum Wage

Starting from July 1, 2024, Romania will implement a legislative change regarding the minimum wage. According to Government Decision no. 598/2024, the gross minimum base salary guaranteed in payment will increase to 3,700 lei per month, an increase of 400 lei from the previous value of 3,300 lei. This change will affect both employees and companies, especially those with more than 50 employees, who must ensure that four percent of their staff consists of people with disabilities.

Regulations and Obligations of Companies

Companies that do not meet this requirement are obliged to pay a monthly fee equivalent to the gross minimum wage for each job not occupied by a person with disabilities. For example, a company with 100 employees would need to hire four people with disabilities or pay a fee of 14,800 RON (4*3700 RON) per month. This amount goes to the state budget in what is colloquially called the disability fund. However, companies can deduct 50 percent of this fee if they purchase products and services from Authorized Protected Units (UPA).

UPAs are legal structures that employ people with disabilities, representing at least 30 percent of the total number of employees, but no fewer than three. Collaboration with these units not only helps companies reduce fees but also supports social inclusion and community development.

The new minimum wage value will also influence fees for unemployed people with disabilities, meaning that budgets allocated to protected units will need to be adjusted accordingly. It is important for each company to be aware of these legislative changes and adjust their budgets to comply with the new regulations.
